1. Acceptance of Terms

By accessing or using our service, including our website, products, and the FramerForms plugin (collectively, the "Services"), you agree to comply with these Terms of Service. If you do not agree with any part of the terms, you may not use our Services.

2. User Responsibilities

Users are responsible for:

  • Maintaining the confidentiality of account information, including passwords

  • Using the Services in compliance with applicable laws

  • Not engaging in prohibited activities

  • Ensuring the accuracy and legality of any content submitted through our Services, including the FramerForms plugin

3. FramerForms Plugin

3.1 Plugin Hosting

Our FramerForms plugin is hosted on the Framer website. By using this plugin, you agree to be bound by both these Terms of Service and Framer's Terms of Service (available at https://www.framer.com/legal/terms-of-service/).

3.2 Responsibilities

  • InsertFrame is responsible for the functionality and maintenance of the FramerForms plugin.

  • Framer is responsible for hosting the plugin and providing the platform on which it operates.

  • Users are responsible for their use of the plugin in accordance with both InsertFrame's and Framer's terms.

3.3 Data Processing

Data submitted through the FramerForms plugin may be processed on Framer's servers before being transmitted to InsertFrame. Users acknowledge and consent to this data flow when using the plugin.

4. Analytics and Tracking

We use PostHog, a third-party analytics service, to track and analyze usage of our Services. By using our Services, you consent to the collection and processing of your data by PostHog in accordance with their privacy policy and our Privacy Policy.

5. Prohibited Activities

Users may not engage in activities that:

  • Violate laws or regulations

  • Infringe on intellectual property rights

  • Harm the integrity of our Services

  • Involve unauthorised access to our systems

  • Include data scraping or distribution of malicious software

  • Attempt to reverse engineer or extract source code from our Services

6. Intellectual Property

The Services and their original content, features, and functionality are owned by InsertFrame and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Termination

We reserve the right to suspend or terminate user accounts for violations of these terms or for any reason at our discretion. Upon termination, your right to use the Services will immediately cease.

8. Limitation of Liability

Our Services are provided "as is." We disclaim all warranties, and we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our Services. This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

9. Changes to Terms

We may modify these Terms of Service at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Services after such modifications will constitute your acknowledgment of the modified Terms of Service and agreement to abide and be bound by the modified Terms of Service.

10. Compliance with Australian Consumer Law (ACL)

These Terms of Service align with the Australian Consumer Law (ACL) and respect consumer guarantees outlined in the ACL. Nothing in these terms is intended to exclude, restrict or modify rights which you may have under the ACL.

11. Governing Law

These Terms of Service are governed by the laws of Australia. Any disputes will be resolved in accordance with the laws of Australia.
